Planning in Brighton

Brighton & Hove City Council is the planning authority. The city has 34 conservation areas, including North Laine, Kemp Town, Preston Park, Round Hill and Queen’s Park. In a conservation area, solar panels are still usually permitted development on a house, but not on a wall that faces the road. Even where no application is needed, a rear roof slope is often the better choice on a terraced street.

Some areas go further. The council’s guidance says Article 4 directions in Ovingdean, Patcham, Portslade Old Village, Rottingdean and Stanmer conservation areas mean solar panels need a planning application there. Listed buildings, of which Brunswick Town and Kemp Town have dozens, need listed building consent as well.

Flats, terraces and outdoor units

If you live in a flat, the roof and outside walls usually belong to the freeholder, so you will need their written consent before panels or an air conditioning outdoor unit go up. If you rent, you will need your landlord’s agreement too. We can give you the survey details to send them.

Houses are more straightforward. Victorian and Edwardian terraces in areas like Hanover and Round Hill often have a usable rear roof slope, and 1930s semis in Patcham and Withdean tend to have side or rear space for an outdoor unit. Air-to-air units on houses have been permitted development since 29 May 2025, with size and siting limits, so a unit tucked at the back is usually the simplest route.
